El trabajo trata del principio de legalidad y de las condiciones que, en opinión del autor, tendrían que concurrir para que dicho principio se controle, eficazmente, por los tribunales de justicia o, más específicamente, por el de lo Contencioso-Administrativo de Guatemala.
El tema se aborda haciendo primero una introducción que trata de los aspectos de la realidad del control jurisdiccional en Guatemala y cómo ésta contrasta con los principios consagrados en su Constitución, en las Leyes y el discurso oficial. Plantea ciertas cuestiones de índole filosófico relativas al ideal del imperio del derecho y precisa el objetivo de la investigación.
A continuación se hace una breve referencia a los antecedentes históricos, previos a al Revolución Francesa, relacionados con el ideal del imperio del derecho, y se describe la problemática que supuso la aplicación tajante de la teoría de la separación de los poderes del Estado en Francia. Enseguida se pasa a un recorrido histórico por las constituciones de Guatemala, partiendo de la de Cádiz, específicamente en lo concerniente a la forma en que se ha regulado el principio de legalidad, tratándose también, después, de las Leyes que han regido la materia de lo Contencioso-Administrativo. Desde esa perspectiva se discuten varias sentencias dictadas por el Tribunal Constitucional o Corte de Constitucionalidad de Guatemala, así como por su Corte Suprema de Justicia respecto de las cuales el autor analiza y critica determinados enfoques que, a juicio suyo, constituyen evidencia de una mentalidad formalista o tímida, en cuanto a la tutela efectiva de los derechos de los administrados por parte de los Tribunales que las dictaron.
La segunda parte del trabajo consta del análisis sintético de los sistemas francés, español, inglés y estadounidense de control de la legalidad de las actuaciones de la Administración, todo ello, desde la perspectiva de las características más importantes que podrían asociarse o relacionarse directamente con la eficacia o materialidad con la que se lleva a cabo dicho control de legalidad en esos países. Del sistema francés se destaca su evolución jurisprudencial; del español, la forma en que tanto la doctrina científica como la jurisprudencial potenciaron las Leyes que se han dictado (sobre todo a partir de la de 1956) y del inglés y estadounidense se destacan las técnicas que se han desarrollado para encarar el fondo de los asuntos de que conocen los Tribunales en esta materia. De ese recorrido se hace una recapitulación que procura recoger, más concentradamente, los diversos puntos específicos que apuntan a que tanto la jurisprudencia desarrollada por los órganos de contralor en todos esos sistemas, como también la doctrina científica, han supuesto, más que la letra de la Ley, la realización efectiva del control de la legalidad de la actuación administrativa.
A partir de esa constatación, en una tercera parte y final, se trata de los aspectos que inciden en la inexistencia de una tradición jurisprudencial y de una doctrina científica sobre el control jurisdiccional de la legalidad en Guatemala, así como también se hacen algunas propuestas relacionadas tanto con esos dos puntos, como también con las reformas que sería necesario realizar a nivel constitucional y además legislativo, para remover las causas principales de una actitud o mentalidad formalista que el autor considera consecuencia directa de las deficiencias o problemas estructurales del sistema contencioso-administrativo y, en general, de la administración de justicia de Guatemala.
Las conclusiones recogen una síntesis del estudio realizado.

This work deals with the principle of the rule of law and the conditions that, in the opinion of his author, would have to concur so that the said principle shall become effectively applied by the courts, or more specifically, by the Administrative Court of Guatemala.
The subject is approached in an introduction that refers to the aspects of Guatemala's reality concerning judicial review and how this reality contrasts with the principles contained in its Constitutions, the Laws and the official discourse. It discusses certain issues of a philosophical nature relative to the ideal of the rule of law and defines the objective of the research task.
The thesis then refers briefly to the history, prior to the French Revolution, of the ideal of the rule of law and describes the problems that the extreme interpretation of the theory of the separation of the powers of the State created in France.
Immediately following this section, the work covers the historical development of the principle of the rule of law in the several constitutions of Guatemala, beginning with the Cadiz Constitutions, dealing also with the laws that have governed the subject matter of judicial review. From that perspective the author proceeds to discuss several rulings of the Constitutional Tribunal and the Supreme Court of Justice of Guatemala, in respect of which the author analyzes and criticizes certain ways of approaching the respective matters which, in his opinions, show a formalist or timid mentality on behalf of said tribunals when it comes to the protection of the rights of the citizens by the Courts.
The second part of the work contains a synthetic analysis of the French, Spanish, English and American systems of judicial review, all from the perspective of the most salient characteristics that could be associated or related with the effectiveness or materiality with which judicial review is carried out in all those countries.
Of the French system the author points out its case law evolution; of the Spanish system, the way in which jurisprudence and scholarly doctrine have enhanced the several laws (notably from that of 1956) that have regulated this matter; and of the English and American systems reference is made to the different techniques that have been developed in order to face the substance of the of the cases brought to the competent Courts.
From this overview the author goes on to a recapping of the most important elements, in a more concentrated way, of the several specific concrete issues that point to the fact that it is the case law and the scholarly doctrine, more than the letter of the law, that have made judicial review of the actions of the Administration an effective reality in all those systems.
On the basis of these findings, in the third and final section, the thesis deals with the aspects that bear on the inexistence of a jurisprudential and scholarly tradition on judicial review in Guatemala and a includes some specific suggestions related with those issues, as well as with those necessary, at both a constitutional and legislative level, in order to remove the principal causes of formalistic attitude and a mentality that the author considers to be a direct consequence of the shortcomings or structural problems of the system of judicial review and, in general of the Court system of Guatemala.
The conclusions consist of a synthesis of the work.
