Análisis empírico-descriptivo de los géneros notariales: el caso del

Abstract

Nuestro objetivo es analizar contrastivamente los documentos notariales españoles y anglosajones, desde la lingüística aplicada y la teoría del análisis de géneros, para crear herramientas y recursos traductológicos que faciliten la labor complementaria del traductor jurídico y del jurista. Primeramente, se revisan los aspectos epistemológicos de la lingüística textual, el género y los principios del Derecho comparado; además de la metodología. A continuación, se procede a un análisis empíricodescriptivo de las divergencias y similitudes del género "poder notarial vs. power of attorney". Se presenta un estudio socioprofesional comparado del notario español y el Notary Public irlandés. Asimismo, se muestran los dos catálogos de géneros notariales. Finalmente, se examinan ambos géneros a través de la ficha de análisis NotGentt. Concluimos que, a pesar de las divergencias conceptuales entre la tradición de derecho anglosajón y la civilista, con sus consecuentes restricciones traductológicas, la “representación” cumple una finalidad comunicativa similar en ambas.

Our aim is to contrastively analyse the notarized document in Spanish and English from the perspective of applied linguistics and genre analysis, in order to create translation tools and resources that ease the complementary task of law translators and lawyers. Firstly, a theoretical study on textual linguistics, genre and comparative law is carried out; besides the methodology used. Then, an empirical descriptive analysis over the differences and similarities of the genres "poder notarial vs. power of attorney" is undertaken. A socioprofesional comparison between the Spanish Notary and the Irish Notary Public is also presented. Furthermore, the two catalogues of documents are shown. Finally, both genres are discussed by means of the NotGentt method of analysis. In conclusion, in spite of the existing conceptual divergences between the Common Law and Civil Law traditions, and its consequent translation restrictions, legal “representation” fulfils a similar communicative purpose in both systems.
