El servicio público audiovisual y la construcción del Estado autonómico: RTVE 1980-2006

Abstract

Esta tesis analiza la forma en que RTVE ha contribuido, entre 1980 y 2006, al desarrollo del Estado autonómico, teniendo en cuenta su función de servicio público. Las fechas escogidas obedecen al periodo marcado por la aprobación de la ley del Estatuto de la Radio y la Televisión (1980) y la ley de la Radio y la Televisión estatal (2006). Ambas normativas delimitan un espacio de tiempo fundamental en el desarrollo del Estado autonómico y la transformación de RTVE. En los capítulos precedentes se considera la noción tradicional de servicio público y los cambios conceptuales y normativos que se han ido produciendo en coincidencia final con la implantación de la banda ancha. Se destaca la formulación jurídica de servicios de interés general y servicios de interés económico general, que en última instancia ha salvaguardado la existencia de las radios y televisiones públicas. Se estudia la articulación territorial de RTVE en sus distintas etapas, como uno de los principales indicadores del grado de vertebración y cohesión que ha ejercido la radiotelevisión pública .De forma paralela, se enjuicia la evolución del Estado autonómico y las tres oleadas de reformas estatutarias que, a pesar de dotarla de un carácter federalizante, no impiden su progresivo cuestionamiento desde posiciones ideológicas antagónicas: recentralización y autodeterminación. Se aborda la duplicidad y el solapamiento de radios y televisiones públicas de titularidad estatal con las de carácter autonómico, en tanto que exponente de la imprevisión de los legisladores y la apetencia de los políticos por controlar el medio televisivo. Se observa la instauración de la televisión privada en España, que provocará un progresivo quebranto en las cuentas de RTVE, generando un endeudamiento superior al billón de las antiguas pesetas. A este deterioro contable de RTVE se sumará una creciente gubernamentalización de sus espacios informativos y de opinión. A partir de esta constatación, se examinan las etapas de los sucesivos directores generales de RTVE, desde 1980 y hasta aprobación de la nueva norma legislativa, en 2006, que regulará la actividad del Grupo. Se valora su alcance legal junto con la aprobación, en 2005, del Plan de la Sociedad Estatal de Participaciones Industriales (SEPI que, entre otras consecuencias, modificará sustancialmente la estructura territorial de RTVE.

ABSTRACT (anglès) This thesis analyses how RTVE has contributed between 1980 and 2006 to the development of the Spanish autonomous communities, considerimg its public service mission. The dates are chosen according to the period from the adoption of the Statute Law of Radio and Television (1980) to the Law of the State Radio and Television (2006). Both regulations define a fundamental episode of time in the development of the Spanish autonomous communities and the transformation of RTVE. The traditional concept of public service is presented in the previous chapters as well as the conceptual and legislation changes that have taken place and have coincided with the deployment of the broadband network. It highlights the legal construction of services of general interest and services of general economic interest, which ultimately have safeguarded the existence of public radio and television broadcasting.It presents a study of the territorial articulation of RTVE in its various stages, as one of the main indicators of the degree of structure and cohesion that has performed. In parallel, it examines the evolution of the Spanish autonomous communities and the three phases of statutory reforms that, although endowing the State with a federalist character, do not prevent it from a progressive questioning from opposite ideological positions: recentralization and self-determination. It addresses the duplication and overlap of state-owned public radio and television stations with the ones managed by the Spanish autonomous communities, as an exponent of the unpredictability of legislators and the desire for politicians to control the television media. It states the introduction of the private television in Spain, which caused a gradual breakdown in the RTVE accounts, generating a debt of more than a billion of the former pesetas. This deterioration of the accounting of RTVE will join a growing governmentalization of its newscasts and opinion contents. Derived from this finding, an evaluation of the management of the successive CEOs RTVE is done, from 1980 to the adoption of the new legislation in 2006, which will regulate the activity of the Group. This legal scope along with the adoption in 2005 of the plan of the Sociedad Estatal de Participaciones Industriales (SEPI) will, besides other consequences, substantially change the regional structure of RTVE.
